Property Suitability

For example, the property is fully enclosed, safe, and suitable for a pet. It is not located in a strata complex where By-Laws exist, and the type of pet is unlikely to cause disturbance or nuisance to neighbouring properties.

Acknowledgement of Terms – Pet Application

I/We acknowledge and understand that:

Consent required
No pet is permitted to be kept in or on the premises unless and until prior written consent has been granted by the property owner, body corporate and or their authorised agent.
Assessment and possible refusal
The property owner may approve or decline the request in accordance with the Residential Tenancy Act and any other applicable legislation, including strata by-laws where relevant.
Dispute process
If the property owner declines the request to keep a pet, the matter may be referred to TASCAT for determination. I/We acknowledge that I/we may be responsible for any costs associated with an application or dispute until the matter is determined.
Pet Agreement required
If approval is granted, I/we will be required to enter into a written Pet Agreement outlining the specific terms, conditions and obligations relating to the keeping of the approved pet, in accordance with relevant legislation.
Agreement provided in advance
I/We acknowledge that a copy of the proposed Pet Agreement will be provided prior to signing, allowing reasonable time for review of the conditions that will apply should approval be granted.
Responsibility for damage
I/We understand that any damage caused by the pet, whether internal or external, fair wear and tear excepted, will be my/our responsibility. Any reasonable costs incurred by the owner to rectify such damage may be recovered from me/us as the tenant.
Revocation of approval
I/We acknowledge that any approval to keep a pet may be revoked by the property owner, subject to and in accordance with the Residential Tenancy Act, if I/we breach any term or condition of the Pet Agreement or fail to comply with my/our obligations.
Ongoing compliance
I/We agree to comply with all conditions of approval, the Pet Agreement, the Residential Tenancy Agreement, and any applicable legislation for the duration of the tenancy.
